Dear Sir/Madam,

I have M.Sc. Computer Science degree, graduated on 1999. I have 10+ years of total experience. Prior to the current employer experience, I have 8 years of experience in Software Industry. Am I eligible under EB2 category ?

please consult a lawyer.

EB category is based on job requirements and candidate's credentials. you can have a phd but if the permanent job position only requires BS degree, it cannot be classified as EB2. you need to find a position that can be classified as EB2 and then if you are qualified for the position, you can apply GC under EB2.

EB2 Eligibility

Thanks so much, for the response.

I have checked with one of the attorneys, who considers the degree I have, is not eligible for EB2 category, on the educational grounds that would qualify an applicant in EB2 category. I am still confused, as the attorney scares me that my application may get rejected later, which case, would leave my status void and I may have to leave the country. I am not ready for that.

Did the attorney explain why? Some attorneys are better than others. Some have experience in the area you need it and some do not. Interview a few.

The employer chooses the attorney. The petition is for the employee in this case.

The attorney will advise the proper filing strategy for the best possible result for the employer - and thus the employee.

As the employee, you are just to provide what is requested from you - especially at the intial phase. You can not taint the labor certification process by your participation in decisions and recruiting.
