Hi, I am on OPT these days and I am planning to file H1 with this employer in April 2010. But he pays me $40k every year. Is it ok to file H1 with this salary or do I have to find other employer.
Please give me some information regarding this.

please consult a lawyer.

your answer will depend on what city/state you are working, what kind of occupation, etc. refer to OES wage data if your salary is at least the proferred wage.

For an H1, the salary has to at least match the prevailing wage in the region where the job is located.
There is no "one size fits all." You would have to find out what the prevailing wage is for your case. That information is often available online.
