USCIS Sent RFE for me an my wife in two weeks gap in march to my attorney.Since my Lawyer has to change address at that time he did not answer mine but answered my wife's.On April 4'th week i got an mail that my I-485 got denied for not answering the RFE.My wife's also got denied on May second week.When i contacted my Attorney he told that i need not worry and can apply MTR.While applying MTR he told that if MTR is applied for mine it will be automatically applied to her.USCIS reopend my I-485 but my WIFE'S I-485 is still showing denied.When i called the customer service they were saying that he should apply MTR for both of us and it's too late for my spoUse I-485 TO reopen since it's been 4 months passed .Please help me on this.

I am also on same boat. I applied for MTR and waiting for decision. My attorney only included my wife's name and she didn't apply for my wife seperately. I will update as soon as i hear from USCIS on my case. Good luck please update if you find any answers.

When a motion is not filed that should have been filed, it is generally possible to file it late. Generally, lateness requires showing that its failure was due to extraordinary circumstances. Consulting with an attorney experience with such matters is often advisable.
