I have an approved I140 and my 485 has been pending for more than 2 years now. I have EAD and AP. I plan to use AC21 to move to a different company (same job duties). My question is..

1. What happens if my GC sponsor employer cancelles my I140 after I move to a different company using AC21. Would it jeopardize my GC approval?

2. What happens if my GC sponsor employer goes out of business some time after I move to a different company using AC21. Would it affect my GC approval?

3. The new company I plan to join dont do visa sponsorships. Do I need any legal obligation/support from them regarding my GC process?

Thanks!!

1. NO. In some cases the USCIS has mistakenly issued a NOID if the previous sponsor yanks the I140. But that is why you need a Lawyer onboard to deal with such issues.

2. NO.

3. Their only role is to provide the Qualifying Job Letter.
