Hi all,
My I485 is pending and I got an RFE for unclassifiable fingerprints.I had been for fingerprinting twice and on both occassions my fingerprints were unclear and were rejected. Last week I received a letter from USCIS which stated that I need to submit
"a five-year certification of good conduct/police clearance from the local law enforcement agency such as the Police department or the Sherriff's office"

I am supposed to respond back within 12 weeeks.

Could anyone with similar RFEs share your experiences please.

What is the format in which I need to submit the clearance certificates?

How can I approach the Police department. Is there any special division that deals with such matters?

I had lived in a couple of cities in the US for the last 3 years before which I was in India.
What is the procedure for obtaining a police clearance certificate from India?

Because USCIS has given me 12 weeks to respond, I am wondering if getting the police clearance is a lengthy and time consuming process. If yes, in how much time can one get a police clearance certificate both in US and in India?

After the submission of Police clearance certificate, is there any other process that needs to be carried out for unclassifiable fingerprints, so that I485 processing goes on unaffected?

Please help by answering my queries. Your help will be greatly appreciated.

Fingerprinting

My wife is expecting similar situation. It is a probability that it will be denied second time. You can ask request from sheriff dept/polce dept. You have to fill the form and they will send it back to u after looking report. In a small town it is free. In big town it costs come money. It does not take that long. Apply rightway. Go to the town;s website. or visit that place. Email them they will send you a form which u can fax. That is what they did to us in small town, USA.
How long did it take for u to get that rfe after second finger print?

I received the RFE 1.5 years after my second FP apppointment.
Do you have any idea how one can obtain such police clearance certificates from India and the time it takes to get one from India.
Inputs please.

Hi - same RFE

My wife received same RFE, unclear finger prints, "five-year certification of good conduct/police clearance from the local law
enforcement agency such as the Police Department or Sheriffs Office of each city in the United States
where you have resided in the past five years"

Please let me know, how is your luck with local Police departments, Is state police report work. Please share. Thanks.

I reside in NC and I contacted the State Police and Sheriff's office. Both of them directed me to the court house for police clearance and also told me that only court house would handle such cases. But the RFE notice from USCIS clearly states that court clearances are not acceptable. Please advise on how i need to proceed with this

Any local law enforcement agency

I think any local law enforcement agency should be fine. We are in the process of getting from various cities. Already got 2, 3 more remaining :( Hopeful to get it by next week. Need to reply to the RFE by end of the month, unfortunately we got only 30 days time.

You are right

Sorry for my previous post. I looked at the notice again, and it says "Please note, court clearances and third party public access company clearances are not acceptable.". What I found out is all the cities we lived, they have a Records department associated with Sheriff's office or Police department. They charge a fee <10$ for the criminal records check certificate. That is what we are getting. Hope this helps. Try that way.

I guess your IO is also the same person(XM1136)

I replied

Hi amadhubi,

Our attorney replied to RFE and it was received on 06/30/09 and status changed to RFE response received. Just make sure, you atleast get a Criminal check result from the local police station/sheriff's office. Some may not explicitly say clearance letter, some does.

Attorney was fine with the letters we provided. One city police delayed too much, but finally sent it.

Good luck to you. I will let you know if I hear anything else from USCIS.

I have the same problem. My fingerprint was to small to read and now they ucis wnats a police clearance from california and North Carolina. I have the california police clarance now I need the NC one.How can I get one from NC without going to North Carolina. Any advise

im in same boat

1st FP on jan 2008 - no problems, name check and background check cleared

2nd FP refresh setp 2009 - rejected
3rd FP refresh Oct 1st 20098 - rejected. found out by calling FBI customer service.

how long after 2 rejections can i expect to recieve RFE or interview notice from USCIS ? has anyone successfully got GC approved with this case ?
my PD is current now, so im nervous. thanks all
