My visa and I-94 expired(30 Sep 2009), passport also expired(30 Sep. 2009) but have a new one now. My i797 is valid until May 2010.

I came to US on company A and transfered to Company B, i got I797 with I94 and the validity is till 20 May 2010.

I went to India with my old visa and came back with the same, At the POE i showed the officer my new i797 but they gave me i94 until my passport validity 30 Sep.2009. Today, after my HR called, I found out that I am out of status.

hi

I have called SFO office before when I was in your situation in August 2009. but they said they can not help me. but you might find success since your lawyer is going there.
If not, please go to Seattle CBP office. There is no need of lawyer going there. you can do it yourself,
good luck
