I am in my 6th year of H1 and my I140 in EB 3 category was approved in the month of April 2008. If I switch jobs at this time and move to a new company into a position with the same requirements and if the company agrees to sponsor my GC as EB2, can i still retain my priority date from the current EB 3 application.

please consult a lawyer.

job requirement determines EB category. yes, you can port old PD by attaching a copy of approved I-140 on your new I-140 application.
